It looks like my case was "featured" in Newsweek in Nov 2024 (they never called me..)
When I read this, I keep hearing Billy Joel - "you may be right.. I may be crazy, but I just might be the lunatic you're looking for.."
Hm, at least some of that's not true.
Here is the application I filed for Leave to File a Motion for a Writ of Mandamus to remove the vexatious designation, since (as evidenced by the Newsweek article, it's clearly being used to prejudice and punish while the active cases are still being considered.
In theory, I have no problem having a judge check documents before they hit the docket, but that's not what he's doing, Judge Aenlle-Rocha just filters them, this is filed with the US Court of Appeals for the 9th Circuit
MOVING FORWARD
OK, I get it, the court only has time for "serious people", btw - when do the Panama and Greenland invasions begin? I would like to firm up my travel plans.
We impeached him, Republicans said, "but what crime did he commit? do you have finger prints? oh? how about pinky prints? You saw it? Well that doesn't count" (McConnell says 'this is a matter for the courts'), the DOJ indicted him for loads of crimes, collected a mountain of evidence, and the supreme court said, "woa woa, wait a minute, you can't arrest someone for crimes they did while they were busy Presidenting - you sure he wasn't Presidenting when he attacked congress?", Colorado said, "hey wait, there's a Constitutional Amendment for that (14sec3), and the supreme court said 'who's to say? insurrection? It could be a ham sandwich. Anyway it's a Federal Matter. Ask Congress again?'
It's not clear to me how many laps around every branch of government, and trips up and down every level of the court we're supposed to make before we can examine the merits of an insurrection in court, but let's try and see. You would think the merits would be pretty important priority for the courts. Nothing personal fellas, just tell us the rules, OK? These suits simply attempt to get them to clarify rules and declare fact and law, so we don't have to chase our tail anymore trying to hold these guys to account.
Here is a list of the Donald Trump's 4095 actually vexatious law suits : https://www.usatoday.com/pages/interactives/trump-lawsuits/
Just tell me the rules, and make MAGA follow them too.
I feel pretty confident that the appeal will at the very least overturn that designation, which besides being inconvenient, prejudices my active cases - with any luck, my hope is they will remand the case back to the district court for compelled discovery (such as Subpoenas to testify I had already obtained). But as the Newsweek article shows, his misleading order, seems to intentionally place a black cloud over anything I do and obstruct discovery. None of that is what the Vexatious designation covers. Vexatious generally doesn't turn on the "who" or "how" of a case, but the "why" of the case, such as revenge, exploitation, or intimidation. Any of those motivations sound familiar? Sure they do. Corporations and the wealthy (like Trump) specialize in exactly that kind of litigation, and get a pretty free hand at it. I am happy to push back on this misuse of the 'vexatious' rules of the court, they are every bit as corrupt as the core judicial corruption issues brought in the case.
You can't make an omelet.. as the saying goes. Not every day has to be a "good day".
